CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 28.02.2019 By this petition the petitioner had sought furlough as also quashing of the orders dated 29th August, 2018 and 5th November, 2018 whereby his application seeking first spell of furlough was rejected. During the pendency of hearing of this petition learned counsel for the petitioner submitted that the marriage of the petitioner's sister has been fixed on 12th March, 2019 and thus he may be granted parole. Considering the exigencies of the situation this Court treated the present petition as a petition seeking parole and directed the State to verify the factum.

A status report has been handed-over by learned Additional Standing Counsel for the State which is taken on record. As per the status report the factum of the marriage of petitioner's sister to be performed on 12th March, 2019 has been verified.

W.P.(CRL) 592/2019

Considering the fact verified and that as per the nominal roll the petitioner was earlier also granted parole by this Court which concession he did not misuse, this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹10,000/- with one surety bond of the like amount to the satisfaction of the Superintendent Jail.

Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent Tihar Jail forthwith.
