% 25.02.2019 Petitioner no.1 (husband) and respondent no. 2 (wife) are present in Court that have been identified by SI Ashish Sharma of police station Jafrabad. They submit that they have started living together after settling their disputes amicably before the Delhi Mediation Centre, Karkardooma Courts, Delhi on 26.09.2018.
Respondent no.2 confirms these facts and states that presently she has no grievance against petitioner no.1 or his family members, that is, petitioner nos. 2 and 3. She further submits that in view of the settlement she is not interested in pursuing the FIR No. 127/2017 under Sections 498-A/323 IPC registered at Police Station Jafrabad and the same may be quashed.
Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
