O.M.P.(MISC.)(COMM.) 61/2020 2.

This is a petition under Section 29A(4) and (5) of the Arbitration and Conciliation Act, 1996 seeking extension of time for completion of the arbitral proceedings and rendering an award by a period of six months.

Learned counsel for the petitioner submits that the learned Arbitral Tribunal had entered reference on 02.08.2018 and despite the parties having diligently participated in the arbitration proceedings, the same have yet not concluded, and in the meanwhile the mandate

of the Arbitral Tribunal has expired on 31.01.2020. He, therefore, prays that the mandate of the Arbitral Tribunal be extended for a period of six months.

Issue notice. Learned counsel for the respondent accepts notice and does not oppose the petition.

Keeping in view the fact that much time and labour has already been invested in the proceedings, the time for completion of arbitration proceedings and rendering of award is extended by a period of six months. The mandate of the Arbitral Tribunal is accordingly extended till 31.07.2020, effective from 01.02.2020. 5.

The petition is disposed of.
