The petitioner has filed the present petition seeking bail in connection with FIR No. 99/2017, under Sections 392/395/397/412/34/120B of the IPC and Section 25 of the Arms Act, 1959, registered with Police Station Sagar Pur, New Delhi.

It is alleged that the petitioner, along with one other co-accused, had robbed the complainant of a sum of ₹15,90,000/-. It is stated that the petitioner and his co-accused accosted the employee of the complainant and had robbed the bag containing cash on a gun point. They had thereafter
escaped on a motorcycle.

Apart from the petitioner and his co-accused, who are alleged to be directly involved in committing the crime; there are two other co-accused, one who had allegedly provided the information (Ravi) and the other (Deepak) who was also alleged to be present at the spot. The accused Ravi and Deepak have been released on bail.

The petitioner was arrested on 12.05.2017 and has been in custody for over two years and nine months.

The status report indicates that the prosecution intends to examine eighteen witnesses out of which only seven witnesses have been examined. 8.
Considering the circumstances of the case and the fact that the petitioner has been in custody for a considerable period of time, this Court considers it apposite to allow the present petition. 9.
The petitioner is directed to be released on bail on his furnishing a personal bond in the sum of ₹15,000/- with two sureties (who are permanent residents of Delhi and one of whom is a relative of the petitioner) of an equivalent amount to the satisfaction of the Trial Court. This is also subject to the following further conditions:
(a) The petitioner shall not leave the National Capital Territory of Delhi. (b) The petitioner shall report to the concerned police station (Police Station Sagar Pur) and mark his presence on each first and third Monday of every calendar month.
(c) The petitioner shall provide his mobile number and ensure that he is reachable at all times.
(d) This order is also subject to the petitioner's local address being verified.
