% 06.07.2017 Mr. Baruah, ld. Counsel for respondent nos. 2 and 3 seeks further time to file counter affidavit in terms of the last order. Ld.

Counsel appearing for the petitioner also seeks adjournment stating that he has been engaged recently and even the brief has not yet been handed over to him.

It transpires that it is a contempt petition, which was filed way back in April, 2011. We are now, in July, 2017 and adjournments are being sought by the parties for one reason or the other. Subject to costs of Rs.15,000/- to be deposited with DHCLSC by the respondents for seeking time to file counter affidavit in terms of the last order, respondent nos. 2 & 3 are given another opportunity to file the reply affidavit in terms of the last order within three weeks from today.

Simultaneously, for the adjournment sought on behalf of the

petitioner, adjournment is granted to the petitioner, subject to deposit of costs of Rs.25,000/- with DHCLSC within fifteen days from today. At this stage, Mr. Amitesh Gaurav, ld. Counsel appearing for the petitioner submits that it is on account of inadvertence that he has appeared for the petitioner Baljeet Singh and that, actually he got instructions to appear only on behalf of petitioner no.2 Kuldeep Dalal and not the petitioner Baljeet Singh.

Petition is filed only by one Baljeet Singh.

Inadvertent appearance of Mr. Amitesh Gaurav, Adv. is therefore, excused, but, with a word of caution to him to be careful in future. Since none appears for the petitioner, petition is dismissed. A. K. CHAWLA, J JULY 06, 2017 rc
