% 27.04.2016 The present petition has been filed on behalf of the petitioner under Section 439 Cr.P.C. for the grant of regular bail in FIR No.254/2014, under Sections 397/411 IPC, Police Station Old Delhi Railway Station.
The petition came up for hearing on 15.01.2015 on which date, learned APP sought time to file the status report. Ld. APP submitted that the prosecution will ensure the presence of the complainant before the trial court on 17.03.2015 and the matter was adjourned to 06.04.2015. On 06.04.2015, it was informed that the evidence of the complainant could not be recorded on 17.03.2015 and the matter was adjourned to 10.07.2015.
On 10.07.2015, it was informed that the examination in chief of the complainant was recorded by the trial court and the matter was adjourned to 04.11.2015. On 04.11.2015, on
the request of the counsel for the petitioner, the matter was adjourned to 19.01.2016.
On 19.01.2016, nobody appeared on behalf of the petitioner. However, in the interest of justice, no adverse order was passed and the matter was adjourned for today. Today again, nobody appeared on behalf of the petitioner.
In the facts and circumstances, the present petition is dismissed for non-prosecution.
