The learned Special Counsel who appears for the respondent objects to the maintainability of the bail application before this Court stating that under Section 12 of the Maharashtra Control of Organised Crime Act, 1999 (MCOCA), only the appeal lies against the dismissal of the application by the designated Court.

In support he places reliance on the decision of a Coordinate Bench in Manjeet @ Khandela @ Khandewla v. State Govt. of NCT of Delhi bail application number 3789/2024 and Satinder v. State NCT of Delhi and Anr. CRL.A. 214/2024 wherein the Coordinate Bench directed that the bail application be renumbered as an appeal under Section 12 of MCOCA. The attention of this Court is also drawn to the order dated 04.12.2025 passed in CRL.A.1676/2025, arising out of same FIR, wherein a similar order had been passed by Predecessor Bench of this Court. 5.

The Registry is accordingly directed to renumber the present bail application as an appeal under Section 12 of MCOCA. 6.

By way of the present application, the applicant seeks grant of interim bail for a period of one month in case arising out of FIR bearing No. 165/2024, registered at Police Station Crime Branch South, Delhi for the commission of offence punishable under Sections 3/4 of the Maharashtra Control of Organized Crime Act, 1999 (hereafter „MCOCA‟) read with Section 25 of Arms Act, 1959 and Section 209/238/62 of the Bharatiya Nyaya Sanhita, 2023 (hereafter „BNS‟).

The learned counsel appearing on behalf of the applicant states that the surgery of son of the applicant is to be conducted on Friday i.e. 03.04.2026 and he remains admitted in the hospital, though, the learned Special Counsel for the State submits that as per the verification report, the surgery of son of the applicant is to be conducted today itself. 8.

Be that as it may, since the factum of the surgery of son of the applicant is verified and keeping in mind the period of custody undergone by the present accused, this Court is inclined to grant interim bail to the applicant, who will be released tomorrow i.e. 02.04.2026 for a period of four The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

(04) days, after verification of surety bond and he will surrender without seeking any further extension, on expiry of period of four days, subject to following conditions:

I. The applicant shall furnish a personal bond in the sum of Rs.25,000/- with two sureties of the like amount, to the satisfaction of the concerned Jail Superintendent. II. The applicant shall surrender his passport, and will not leave the country during this period.

III. The applicant shall also provide his mobile number to the Jail Superintendent, as well as I.O./S.H.O. concerned, which shall be kept operational at all times.

IV. The applicant shall immediately surrender after the expiry of the period of interim bail before the concerned jail authorities. V. The applicant shall not approach any of the prosecution witnesses and shall not indulge in any criminal activity during the period of interim bail.

It is also clarified that in case, the surgery is not conducted on 03.04.2026 and is postponed for any reason, the applicant shall surrender forthwith.

Accordingly, the present application stands disposed of. 11.
