The Petitioner is serving a life sentence in relation to his conviction in FIR No. 484/2003 under Section 302 and 34 of the Indian Penal Code, 1860, registered at P.S. Adarsh Nagar. Through the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the Petitioner seeks parole for a period of one month on the ground that his wife needs urgent surgery and he has to arrange for appropriate funds for the same.

As per the status report filed by the State, the medical records furnished by the Petitioner have been verified and it is confirmed that the surgery of the Petitioner's wife is scheduled for 12th March, 2025 at Kalra Hospital, Kirti Nagar, New Delhi. For this purpose, she needs to be admitted at the said Hospital on 11th March, 2025.

It is pertinent to note that previously when the Petitioner was released on parole, there was a delay on his part in surrendering. However, considering the fact that as per the nominal roll, the Petitioner has been in custody for 17 years, 6 months and 16 days and has also earned remission of 2 years, 11 months and 7 days, and further considering the medical need of the Petitioner's spouse, the Court is inclined to accept the Petitioner's request for grant of parole for a period of ten days from the date of his release on the following conditions:
i.
The Petitioner shall furnish a personal bond in the sum of INR 10,000/- with one surety of the like amount, to the satisfaction of the Jail Superintendent.
ii.
The Petitioner shall not leave the NCT of Delhi, during the period of parole, without the prior permission of the concerned Court; iii.
At the time of furnishing bail bond, the Petitioner shall provide the mobile number(s) to the concerned Jail Superintendent and SHO of the local Police Station, which mobile number(s) shall be kept operational at all times during the period of his release;
iv.
Immediately upon the expiry of period of parole, the Petitioner shall positively surrender before the Jail Superintendent. 4.
With the above directions, the present petition stands disposed of. 5.
Copy of the order be communicated to the concerned Jail Superintendent electronically for information and necessary compliance.
