The Petitioner assails the legality of his transfer/posting to Akhnoor, near Jammu. It is his case that his parents are aged and ailing, and that he is also pursuing an MBA course after having obtained permission from the competent authority. 2.

Learned counsel appearing for the Respondents submits that the Petitioner has, for a substantial part of his service tenure, remained posted in peace areas, and has now been posted to Akhnoor, Jammu, in view of service requirements. It is further submitted that the permission to pursue further studies had been obtained by the Petitioner from the Administrative Officer and not from the Commanding Officer.

Be that as it may, interference by this Court in matters relating to transfer and posting is not ordinarily warranted unless a case of mala fides or manifest arbitrariness is made out. restraint assumes greater significance in matters concerning the Armed Forces.

In view of the aforesaid, this Court does not find any ground warranting interference in the present writ petition. The same is, accordingly, dismissed. Pending application(s), if any, shall also stand disposed of.
