% 27.02.2019 The petitioner is the complainant of the criminal complaint case (CC no.2860/1) involving offences punishable under Section 138 of the Negotiable Instruments Act, 1881, the respondents herein statedly having been summoned as accused on the basis of preliminary inquiry. The petitioner refers to mediation settlement entered upon by the parties on 04.06.2016 to contend that further proceedings by the Metropolitan Magistrate are uncalled for, the matter requiring to be considered only in light of the said settlement. After some hearing, it having been conceded that the Metropolitan Magistrate has not been requested to pass any effective order on the settlement dated 04.06.2016, the counsel for the petitioner now seeks permission to withdraw the present petition seeking liberty to approach the Metropolitan Magistrate with CRL.M.C. 1044/2019

appropriate prayer on such basis.
