% 02.03.2017 RC.REV. 28/2017 & CM No.2648/2017 Learned counsel appearing for the petitioner submits that he has taken instructions that the petitioners would be willing to give an undertaking to the court to vacate the tenanted property within two years from today i.e. on or before 02.03.2019.

Learned counsel for the respondent submits that some reasonable payment should be made for the user charges of the property inasmuch as the agreed rent is very nominal of Rs.5/- per month. Parties have agreed that the petitioners shall pay user charges of Rs.1,000/- per month henceforth. The petitioners shall file an affidavit undertaking of the petitioners to vacate the tenanted property i.e. 9965, XV, Gali No.4, Multani Dhanda, New Delhi-110055 as described in the Eviction Petition within two years from today i.e. on or before 02.03.2019. They will also give an undertaking to pay user charges @ Rs.1,000/- per month by the 7th day of each month

w.e.f. 1.3.2017. They will also undertake to pay the electricity and water charges of the rented premises to the concerned authorities. The petitioners will also undertake not to induct any third person in the tenanted property or cause any wilful damage to the tenanted property. The affidavits shall be filed within two weeks from today. In view of the above, learned counsel for the petitioners submits that he does not wish to further pursue this petition. Learned counsel for the respondent submits that in case the petitioners file the affidavit within two weeks from today the respondent shall not execute the eviction order till 2.3.2019.

With the above, the present petition stands disposed of. All pending applications, if any, also stand disposed of. Learned counsel for the respondent may provide the account No. of the respondent to learned counsel for the petitioner.
