IN THE HIGH COURT OF DELHI AT NEW DELHI

+ W.P.(C) 1945/2019 SANJAY VASHISHTHA ..... Petitioner Through:

Mr Mukesh Anand, Advocate.

versus THE REGISTRAR OF SOCIETIES & ORS ..... Respondents Through:

Mr Rishikesh Kumar, ASC with Mr Premsagar Pal, Advocate.

CORAM:

HON'BLE MR. JUSTICE VIBHU BAKHRU

O R D E R

% 25.02.2019 CM No.9072/2019 1.

Allowed, subject to all just exceptions.

W.P.(C) 1945/2019 2.

The petitioner has filed the present petition, inter alia, praying that directions be issued to the respondents to facilitate the election of the office bearers of the respondent society. It is seen that Registrar of Societies is arrayed as respondent no.1. The petitioner's grievance, essentially, relates to the functioning of Samaj Kalyan Parishad (Society) which is a society registered under the Societies Registration Act, 1860. It is the petitioner's case that elections for the office bearers have not been held in accordance with the bye-laws of that society. This is, plainly, a private dispute. The Registrar of Societies is not required to entertain this controversy or hold any elections.

It would, of course, be open for the petitioner to institute

appropriate action in this regard, if so advised. This Court does not consider it apposite to entertain the disputes between the petitioner and other members of the said society in these proceedings. 3.

The petition is, accordingly, disposed of.
