Learned counsel for the petitioner submitted that the Special Power of Attorney, through whom the complaint was filed before the Trial Court, refused to depose before the Trial Court. Hence, the petitioner has himself come to India to depose before the Trial Court. Learned counsel for the petitioner further submitted that since the petitioner has come to India, hence his evidence should now be recorded by the Trial Court. I am not convinced with the submissions of the learned counsel for the petitioner, more so in view of the reasoning given by the Trial Court in its impugned order dated 20.2.2019.

Learned counsel for the petitioner, at this stage, seeks permission to withdraw the petition, with liberty to move an application for recording of evidence of the petitioner through video conferencing, as per law.

Accordingly, the petition is dismissed as withdrawn, with liberty as prayed.
