O R D E R
% 18.11.2019 This common order shall dispose of all the above mentioned three bail applications in FIR No. 0406 of 2017 registered at P.S. Kalkaji.
As per the prosecution case, Sandeep Lamba one of the accused/applicant herein had entered into an alleged agreement to sell first floor with parking and lift of property bearing no. 7/66, Ramesh Nagar, New Delhi to complainant for a total sale consideration of Rs. 1,10,00,000/- when he was not actually the owner of the said property. Pursuant to the request made on behalf of the prosecution, accusedapplicants were directed to give their specimen signatures and the same were initially sent to FSL, Rohini and admittedly, the said FSL opined that the signatures on one of the witnesses matched with the signatures on the agreement to sell' and the 'receipts' issued by the petitioners. However, the reports received from two independent examiners at CFSL, CBI reveal that the specimen signatures do not match with the signatures on the receipts and the agreement to sell.
Keeping in view the facts and circumstances of the case, I hereby direct the SHO/ Arresting Officer/IO concerned that in the event of arrest, the petitioners/ applicants be enlarged on bail on the following terms and conditions:- (i) That the petitioners shall furnish personal bonds in the sum of ₹25,000/- each with one surety each in the like amount subject to the satisfaction of Arresting Officer/SHO/IO concerned; (ii) That the petitioners/applicants shall cooperate with the investigation and make themselves available for interrogation by police officer, as and when required;
(iii) In case of default of aforementioned conditions, the State is at liberty to take appropriate recourse in accordance with law.
Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case(s).
