The present writ petition has been filed seeking the following reliefs: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

It is submitted that a demolition order was passed on 18th August, 2025 in respect of the third floor of the property bearing no. 809-B, Village Chirag Delhi, New Delhi-110017 (hereinafter, 'subject property'). However, no action has been taken by the respondent/ MCD in terms of the said demolition order.

The petitioner has also filed photographs along with the writ petition to show the illegal encroachment carried out by the respondent no.7 in front of the subject property.

Counsel appearing on behalf of the respondent/ MCD, on advance notice, submits that action could not be taken pursuant to the aforesaid demolition order due to various reasons. He submits that since the subject property was occupied, a vacation notice has been issued on 27th March, 2026 to the owner/occupier of the subject property and a copy thereof has been endorsed to the respondent no.6/ SHO, P.S. Malviya Nagar. He further submits that the respondent/ MCD will take action in respect of the unauthorised construction and illegal encroachment being carried out at the subject property.

Considering the aforesaid submissions, a direction is issued to the respondent/ MCD as well as the respondent no.6/ SHO, P.S. In view thereof, the petition along with the pending application stands disposed of.

In the event the petitioner has any further grievance with regard to the unauthorised construction, he is at liberty to take appropriate remedies in accordance with law.
