% 17.02.2020 C.M. No.5858/2020 (exemption) Exemption allowed, subject to all just exceptions. Application stands disposed of.
W.P.(C) No.1691/2020 The present petition is directed against the order dated 19.12.2019 passed by the Central Administrative Tribunal ('Tribunal' for short). Counsel for the petitioner submits that while issuing notice in the matter, notice has been issued in the O.A., however no order has been passed on the prayer as per para 9 seeking interim relief. Learned counsel for the petitioner further submits that the prayer for interim relief was pressed, however no order has been passed by the Tribunal either allowing or disallowing relief.
We have heard learned counsel for the petitioner. The order dated 19.12.2019 reads as under:- "OA No.3673/2019 Issue notice.
Mr G S Virk, learned counsel accepts notice on behalf of respondent no 1. Learned counsel for respondent no 1 seeks and is allowed four weeks' time for filing counter reply. Rejoinder, if any, be filed within a period of two weeks thereafter.
List before Principal Registrar's Court on 13.03.2020 for completion of pleadings.
MA No. 4065/2019 MA No.4065/2019 for joining together is allowed. (PRADEEP KUMAR) (JUSTICE VIJAY LAKSHMI) MEMBER (A) MEMBER (J)"
A reading of the order would show that there is no reference to any submission with regard to the interim relief having been pressed. We accordingly allow the petition to the extent that liberty is granted to the petitioner to make a specific M.A. for interim relief ; and the Tribunal is directed to consider and decide the application in accordance with law.
With these directions, the petition is disposed of. G.S.SISTANI, J ANUP JAIRAM BHAMBHANI, J FEBRUARY 17, 2020/Ne
