O R D E R
% 17.02.2020 The present petition is filed under section 438 read with section 482 Cr.P.C. on behalf of petitioner for grant of anticipatory bail in pursuance to FIR No.73/2018 registered at Police Station Barakhamba Road, later on transferred to Cyber Cell, for the offences punishable under section 406/420/120B IPC and sections 66/67 of the Information & Technology Act. It is not in dispute that petitioner had collected Rs.40 lacs from investors through cheque or RTGS, however, counsel for the petitioner, on instructions, is ready to deposit Rs.40 lacs along with interest accrued thereon, within two weeks from today in favour of Registrar General of this Court, without prejudice to his rights and contentions. Keeping in view the facts and circumstances of the case, this Court is of the considered view that the present case is fit for anticipatory bail. The
IO concerned, is hereby directed that in the event of arrest, petitioner/ applicant shall be released on bail on the following terms and conditions:- (vii) Petitioner shall furnish a personal bond in the sum of Rs.1 lac with one surety of the like amount subject to the satisfaction of IO concerned;
(viii) Petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required;
In case of default of aforementioned conditions, the State is at liberty to take appropriate recourse in accordance with law. Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case.
The petition is, accordingly, allowed and disposed of. Copy of this order be transmitted to the Jail Superintendent and the Trial Court concerned for compliance.

SURESH KUMAR KAIT, J FEBRUARY 17, 2020 ab At this stage, learned APP has brought to the notice of this Court that learned MM, New Delhi has allowed the production warrant application filed by the police vide order dated 17.02.2020. It is not in dispute that petitioner is in police custody in FIR no. 292/2019, registered at Police Station EOW, for the offences punishable
under Section 406/420 IPC.
In view of above, I hereby direct that on completion of interrogation as directed by learned MM, New Delhi vide order dated 17.02.2020, he shall be released on bail as directed above.
I further make it clear that order passed by this court has nothing to do with FIR No. 292/2019.
