By virtue of the present petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 (Cr.P.C), the petitioner seeks to direct the respondents to decide the representation/ complaint of the petitioner dated 27.11.2025 and take appropriate actions as per law.

At the outset, learned ASC for the State after handing over a copy of the order dated 07.03.2019 passed by the learned MM-03 (SHD), Delhi in CC No.37 MSP/1, PS: M.S. Park, Delhi titled as "Sh. Amit Kumar @ Shyam Singh Vs. Sh. Manish Kumar Sharma & Ors.", which is taken on record, submits that by virtue of the said order the learned Trial Court has already dismissed an earlier application under Section 156(3) Cr.P.C The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. wherein the petitioner had sought to raise the very same issues. He submits that the same finds no mention in the present petition. 3.
He further submits that by way of the fresh complaint/ representation dated 27.11.2025 the petitioner is guilty of raising the same issue(s) once again which have already given a quietus by the learned Trail Court by a speaking order, which has not since been challenged and has thus become final and binding.

He, thus, seeks dismissal of the present petition with exemplary costs.

At this stage, learned counsel for the petitioner seeks, and is granted, leave to withdraw the present petition, albeit, subject to costs of Rs.10,000/- to be paid to Delhi High Court Staff Welfare Fund [A/C 15530110074442; IFSC UCBA0001553] within a period of two weeks. 6.
As such, the present petition alongwith the pending application is dismissed as withdrawn.
