% 13.02.2020 Crl. M.A. No. 3312/2020 (for exemption) Exemption allowed subject to just exceptions. The application stands disposed of.

CRL.M.C. 803/2020 The petitioner has challenged the impugned order dated 21.12.2019 whereby costs of Rs.50,000/- has been imposed upon the petitioner for allowing the application under Section 5 of the Limitation Act.

Costs have been directed to be deposited with the Prime Minister's Fund.

It is submitted by the counsel for the petitioner that this is a

matrimonial dispute and the daughter of the petitioner has been surviving on the maintenance provided by respondent no.2. He further submits that petitioner is also not in a position to pay such a heavy costs and petitioner prays for waiving of the costs. In any case, in my opinion, the costs imposed is on the higher side and looking into the facts and circumstances, the costs imposed vide order dated 21.12.2019 is reduced from Rs.50,000/- to Rs.10,000/-, to be deposited within a period of two weeks from today with the Prime Minister's Relief Fund.

The petition stands disposed of accordingly.
