Applicant seeks regular bail in case FIR No. 502/2024 dated 23.08.2024, registered at Police Station Sagar Pur, for commission of offences under Section 64(1) of Bharatiya Nyaya Sanhita (BNS), 2023 (corresponding Section 376 IPC) and Section 6 of Protection of Children from Sexual Offences (POCSO) Act, 2012.

A perusal of the present matter would indicate that the applicant herein had lastly prayed for bail before the learned Court of Sessions in August, 2025 and his such application was dismissed on 30.08.2025. It is informed that victim and another material public witness have already been examined and it seems that after the abovesaid development, no application has been made before the learned Court of Sessions seeking bail. 3.

applicant, without prejudice to his rights and contentions, seeks to withdraw the present application with liberty to approach the learned Court of Sessions. 4.
The application is, accordingly, disposed of as not pressed. 5.
Liberty, as prayed, is granted.

All rights and contentions of parties are left open. 7.
It is, however, made clear that this Court has not made any observation on the merits of the case and it will be entirely upto the learned Trial Court to decide the proposed application, in accordance with law, after giving due opportunity of hearing to both the sides.
