The petitioner has filed this petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ["BNSS"] (corresponding to Section 482 of the Code of Criminal Procedure, 1973 ["CrPC"]), seeking quashing of FIR No. 32/2026 dated 26.01.2026, registered at Police Station Geeta Colony, District Shahdara, Delhi, under Sections 376(2)/506 of the Indian Penal Code, 1860 ["IPC"] and all proceedings emanating therefrom, on the ground of settlement. 2.

The FIR was registered on the allegation of rape on the false pretext of marriage.

learned counsel for the petitioner, states that the marriage has not yet been solemnised. He, therefore, seeks permission to withdraw the present petition, with liberty to approach the Court afresh, without prejudice to the rights of the petitioner, in the event of any change in circumstances. 4.

The petition is accordingly dismissed as withdrawn in terms of the above submission.

It is made clear that this Court has not expressed any opinion on the merits of any future petition that may be filed by the petitioner.
