% 13.02.2020 CM 5820/2020 Exemptions allowed, subject to all just exceptions. WP(C) 1683/2020 & CM 5819/2020 This petition has been filed by the petitioners feeling aggrieved of the non listing of the appeal filed by the petitioners under the provisions of The Delhi Maintenance and Welfare of Parents and Senior Citizens (Amendment) Rules, 2016, for hearing by the Appellate Authority.

The learned counsel for the respondent no.1 has appeared on an advance notice and submits that the appeal/interim application is now listed for consideration on 19th February, 2020 before the Appellate Authority.

In view of the above, the order dated 02.01.2020 passed by the learned District Magistrate in Case No.42/2019 titled Kamla Devi & Ors. vs. Kapil Kumar & Ors. shall not be given effect to till the

consideration of the interim application filed by the petitioner before the Appellate Authority.

The petition is disposed of with the above directions. It is made clear that this Court has not expressed any opinion on the merit of the claim made in the petition. Dasti.
