O R D E R

% 16.02.2016 Impugned order has been passed on 11.7.2014. Eviction petition of the landlord has been decreed. In the course of the proceedings before this Court user charges @ Rs.3000/- per month were directed to be paid vide order dated 14.01.2015 which order was made subject matter of review. The review petition was also dismissed. In spite of the directions the user charges were not paid. Learned counsel for the petitioner today requests that some time may be granted to vacate the suit property. He has taken instructions from his client and accordingly states that he will hand over vacant and physical possession of the suit property to the landlord on or before 31.3.2016. In view of the undertaking furnished by learned counsel for the petitioner (on behalf of the petitioner) learned counsel for the respondent/landlord submits that he will not press the user charges. This undertaking in the form of an affidavit shall be filed before this

Court within a period of one week with advance copy to the landlord. In case no such undertaking is filed within the stipulated period the decree dated 11.7.2014 will be permitted to be executed by the landlord.

Petition disposed of.
