The instant application under Section 151 of the Code of Civil Procedure, 1908 has been filed on behalf of the appellant seeking permission to withdraw the instant appeal.

For the sufficient cause being shown in the application, the same is allowed and the RFA 286/2023 is dismissed as withdrawn in terms of the Settlement Agreement dated 22nd January, 2024 which is appended as Annexure-A to the instant appeal.

It is also directed that the parties shall abide by the terms of the Settlement Agreement dated 22nd January, 2024. Accordingly, the instant appeal stands dismissed as withdrawn as prayed for.
