Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.') (old Section 482 of the Code of Criminal Procedure, 1973) read with Article 227 of the Constitution of India has been filed on behalf of the Petitioner, Ms. Shukla Sarkar for setting-aside and quashing the impugned Summoning Order dated 09.08.2024, passed by the learned JMFC-04, South East District, Saket Courts, New Delhi in Complaint Case No. Ct. Petitioner has been summoned under Section 499/500 of the Indian Penal Code, 1860.

Learned counsel on behalf of the Petitioner, seeks permission to withdraw the present Petition with liberty to approach the Court of learned ASJ.

In view of the submissions made, the Petition is permitted to be withdrawn with liberty as prayed for.

The learned ASJ may consider the time during which the present Petition is pending in the High Court while considering the condonation of delay in filing the present Petition.
