The petitioner has filed the present petition, inter alia, praying for an anticipatory bail in connection with FIR No.0068/2019, under Sections 406/34 of the IPC, registered with PS New Delhi Railway Station. 3.

The FIR in question was lodged on the report filed with the police station that four of accused (other than the petitioner) had slipped away with gold biscuits provided by the complainant. The complainant states that he is engaged in the business of making gold ornaments. As a part of his business, he hands over gold biscuits to his employees, who then use the

same for making ornaments. It was alleged that four such employees, who used to get the ornaments crafted in Bihar, had slipped away along with the gold biscuits. The petitioner's name had not been mentioned in FIR. It is alleged that the said accused persons have disclosed that they had sold some gold biscuits through the petitioner.

It is stated that the main accused persons have already been released on bail on the ground that they are in the process of settling the disputes with the complainant.

Considering the circumstances of this case, this Court considers it apposite to allow the present petition.

The petitioner is granted anticipatory bail on furnishing a Bail Bond in the sum of ₹15,000/- and one surety of an equivalent amount to the satisfaction of the Trial Court. This is subject to the petitioner joining and co-operating in further investigation that may be undertaken by the police officials. The petitioner shall appear before the IO on 14.02.2020 at 4:00 PM. The petitioner shall also provide his mobile number to the IO and shall be reachable on it at all times.

The petition is disposed of with the aforesaid directions. 8.
