A Petition under Section 482 of the Code of Criminal Procedure, 1973 has been filed on behalf of the Petitioner No.1 to 4 seeking quashing of FIR No.494/2016 under Section 451/506/34 IPC registered at Police Station Sarita Vihar, New Delhi.

It is submitted that the Petitioner and the Respondent No.2 were the neighbours and had some dispute in regard to the raising of construction by Respondent No.2. Two cross-FIRs got registered in respect of the incident. Both the matters have been amicably settled. The cross-FIR No.495/2016 has already been quashed.

It is submitted that both the petitioners and respondent No. 2 have already sorted out their all differences with the intervention of their respective persons of the vicinity and they have left no grudge or grievance against each other in any manner whatsoever. The complainant is present in the Court and submits that the matter stands settled with the Petitioners and she has no objection if the FIR is quashed against the petitioners on account of the settlement already arrived at between the parties.

The parties are present before this Court in-person today, and have been identified by their counsel and Investigating Officer concerned. 6.

Considering that it was a neighbourhood dispute which has been amicably settled voluntarily without any fear and coercion in terms of the Mediated Settlement dated 23.04.2022, the Petition is allowed. Accordingly, the FIR bearing No. 494/2016 registered at Police Station Sarita Vihar, for offences punishable under Sections 451/506/34 of the Indian Penal Code, 1860 with all the subsequent proceedings and the charge sheet is hereby quashed qua all the accused persons/Petitioners. 7.

The Petition stands disposed of along with the pending Application(s).
