The learned counsel appearing for the parties, state that the concerned parties (the petitioners and respondent no.2/Puneet Diwan) have arrived at a settlement.

Spicejet Limited (the petitioner in W.P. (C) 494/2019) has agreed to pay a sum of ₹1.35 crores to respondent no.2, in full and final settlement of all his claims. It is stated that the said amount would be paid in two tranches; 50% of the amount will be paid immediately on the parties signing a settlement deed, and the balance 50% of the amount will be paid on or before 20.01.2020. The parties have also agreed to withdraw all the cases filed against each other. This includes the complaints filed by respondent no.2 under Section 138 of the Negotiable Instruments Act, 1881, as well. 3.
Respondent no.2 is present in Court and confirms that the said settlement has been arrived at voluntarily and he does not desire to pursue the FIR in question, subject to receiving the amounts as indicated above. 4.
In view of the above settlement arrived at between the parties, the present petitions are allowed. The FIR in question [FIR No. 29/2019 under Section 420 of the IPC registered with P.S. Greater Kailash] and all proceedings emanating therefrom, are quashed. It is, however, clarified that this is subject to Spicejet Limited complying with its obligations by paying a sum of ₹1.35 crores within the time mentioned above in any event, on or before 20.01.2020. It is clarified that if the said amounts are not paid, respondent no.2 would be at liberty to apply to this Court for reviving his complaint/FIR in question.

The petitions are allowed in the aforesaid terms. The pending applications are disposed of.
