Petition under Section 528 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for has been filed by the Petitioners for quashing of FIR No.0370/2020 under Sections 308/34 IPC registered at PS: Fatehpur Beri and all consequential proceedings emanating therefrom, in terms of Settlement Agreement dated 18.02.2025.

Learned APP for the State and learned counsel for Respondent No.2 appear on advance Notice and accept Notice.

It is submitted that Petitioners and Resopndent No.2 had a fight on 26.09.2020 at around 10:00 PM, on which present FIR No.0370/2020 has been registered. However, parties have amicably settled their disputes and because of that settlement both parties are seeking quashing of the FIR. 5.

by the IO. The parties submit that they have arrived at the settlement without any force, coercion and undue influence and pressure and they have signed the Settlement Agreement dated 18.02.2025 with their wish and will. 6.
In view of Settlement Agreement dated 18.02.2025, present Petition has been filed.

Respondent No.2 is present in the Court and submits that he has no grievance against the Petitioners and also no objection to the quashing of FIR.

On specific query, Respondent No.2 states that it was very dark therefore, he drifted and suffered injuries on his head. He denies that he was hit with any brick or stick, as has been stated by him in his Complaint. 9.
Though it is in the interest of justice to quash the FIR in terms of Settlement Agreement dated 18.02.2025, but looking at the statements made by Respondent No.2 in his Complaint and today before the Court, he is directed to deposit the cost of Rs.10,000/- with the Delhi High Court Advocates‟ Welfare Trust within two weeks.

Consequently, FIR No.0370/2020 under Sections 308/34 IPC registered at PS: Fatehpur Beri, Delhi and all consequential proceedings emanating therefrom are quashed.
