O R D E R
% 27.01.2016 This is an application under Section 438 of Cr.PC moved by the petitioner for grant of anticipatory bail in case FIR No. 1310/2015 under Sections 420/34 IPC registered at Police Station Hari Nagar, Delhi. Status report has been filed by the State.
Complainant is present in person (identified by the Investigating Officer) with her husband who is also an advocate and submits that the matter has been compromised by virtue of a deed of settlement dated 25.01.2016 in pursuant thereof, she has received a demand draft for a sum of Rs.15,900/- which was paid to her by the petitioner and therefore, she does not oppose grant of bail to the petitioner. Learned Additional Public Prosecutor for the State has no objection to release the petitioner on bail, however, it is submitted that the binary/multi level marketing net working business is illegal in India.
Keeping in view the settlement between the parties, it is ordered that in the event of his arrest:- (i) Petitioner be admitted to bail on his executing personal bond in the sum of Rs.15,000/- (Rupees Fifteen Thousand only) with one surety in the like amount to the satisfaction of the concerned I.O./SHO. (ii) He shall join the investigation as and when called for by the I.O. (iii) He shall furnish his address as well as his contact number to the Investigating Officer.
(iv) He shall not threaten or coerce complainant or any prosecution witness. The application is accordingly disposed of.
