O R D E R
% 19.02.2020 Petitioner is seeking parole for two weeks to attend the marriage of his brother, which is scheduled for 25th February, 2020. Petitioner is facing life sentence in FIR No. 697/2007, under Section 307/34 IPC and Sections 25/27/54/59 Arms Act, registered at police station Nand Nagri, Delhi.
Learned counsel for petitioner submits that after dismissal of petitioner's appeal by this Court on 19th November, 2019, petitioner had surrendered before the authorities on 4th December, 2020. In terms of last order, Status report dated 18th February, 2020 and Nominal Roll dated 19th February, 2020 have been placed on record. Learned counsel appearing on behalf of respondent/State submits that factum of marriage of petitioner's brother stands verified. In view of above, this petition is allowed and in the interest of justice, petitioner is granted two weeks' parole from the date of his W.P.(CRL) 445/2020
release to enable him to attend his brother's marriage, which is scheduled for 25th February, 2020 on his furnishing bail bond in the sum of Rs.10,000/- with one surety in the like amount to the satisfaction of the Jail Superintendent, subject to the following conditions: i) The petitioner shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working conditions at all the times. The same shall not be changed without prior intimation to the Jail Superintendent;
ii) The petitioner shall report at the local police station to mark his attendance on every alternate day at 11:00 a.m. during the period of parole;
iii) The petitioner shall duly surrender at the end of the period of parole; and iv) The petitioner shall also not indulge in any criminal activity while on parole.
A copy of this order be communicated to the Jail Superintendent. The petition stands disposed of accordingly.
