The plaintiff had sued for permanent injunction restraining the defendant from passing off their goods as that of the plaintiff and for ancillary reliefs.

The counsel for the defendant on enquiry states that there is no interim order in favour of the plaintiff.

Issues were framed in the suit on 19th November, 2008 with the onus of all the issues being on the plaintiff.

The counsel for the defendant states that the plaintiff examined one witness who also was not tendered for cross-examination inspite of repeated adjournments.

Vide order dated 4th August, 2016 of the Joint Registrar, the evidence of the plaintiff was closed.

A perusal of the order sheet shows that none appeared for the plaintiff on 23rd November, 2015 and 4th August, 2016 also. 8.
