% 22.02.2018 Counsel for the respondent has handed over notice of default of tax and interest dated 20.02.2018.
Counsel for the petitioner has raised objections and states that this order has been issued malafidely to deny refund of more than Rs.11 Lakhs. There has been delay in issuing refund.
Counsel for the petitioner states that he would be filing objections to the aforesaid notice of default on or before 6th March, 2018. In case such objections are filed, the Objection Hearing Authority would dispose of the same within a period of three months from the date the objections are filed. In case the demand raised is found to be contrary to law and set aside, the Objection Hearing Authority would also decide the question of payment of interest and the refund due to the petitioner and a speaking and reasoned order would be passed.
Recording the directions and observations, the writ petition is disposed of. No costs.
