IN THE HIGH COURT OF DELHI AT NEW DELHI

+ CRL.M.C. 1087/2019 YOGESH ADIM & ORS ..... Petitioners Through:

Ms.

Aditi Gupta and Mr.

Ibad Mushtaq, Advs.

versus STATE ( NCT OF DELHI) & ORS ..... Respondents Through:

Ms. Aasha Tiwari, APP with SI Surender Singh, P.S. Vijay Vihar.

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

O R D E R

% 26.02.2019 Petitioner no.1 (husband) and respondent no. 2 (wife) are present in Court and have been identified by SI Surender Singh of police station Vijay Vihar. They submit that they have started living together after settling their disputes amicably vide Compromise Deed dated 20.12.2018. Respondent no.2 confirms these facts and states that presently she has no grievance against petitioner no.1 or his family members, that is, petitioner nos. 2 and 3. She further submits that in view of the settlement she is not interested in pursuing the FIR No. 882/2016 under Sections 498-A/406/34 IPC registered at Police Station Vijay Vihar and the same may be quashed. Keeping in mind that husband and wife have started living together after resolving their differences, in my view, no fruitful purpose would be

served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Dasti.
