By way of this application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks regular bail in connection with FIR 363/2025, dated 21.05.2025, lodged at Police Station Kalindi Kunj, Delhi, under Sections 109(1)/115(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023.

At the very outset, Mr. Yudhvir Singh Chauhan, learned Additional Public Prosecutor, states that two witnesses have already been examined, but five injured victims and three other public witnesses are yet to be examined.

Mr. K.S. the petitioner's right to move the Sessions Court at the appropriate stage. However, he requests that the Trial Court be requested to expedite the recording of evidence of the public witnesses. 4.

I note that, in the present case, the incident is of 20.05.2025, chargesheet was filed in August 2025, charges were framed on 29.10.2025, and the prosecution evidence is in progress currently. There does not seem to be any undue delay in the proceedings at this stage. However, the Trial Court is requested to record the testimony of the public witnesses as expeditiously as possible, having regard to the position of its Board and the age of the matters pending before it. Mr. Chauhan assures the Court that the prosecution will also cooperate in this process.

The bail application, alongwith pending application, is dismissed as withdrawn in terms of the aforesaid observations. The rights and contentions of the petitioner to move the Sessions Court at the appropriate stage remain reserved.

It is clarified that this Court has not made any observation on the merits of the case, and all rights and contentions of the parties in any future application are left open.
