O R D E R

The petitioners seek quashing of FIR No. 340 of 2017 under Sections 323/341/354/354B/308/34 of the IPC Police Station Fatehpur Beri, New Delhi, on the basis of a settlement. 2.

The parties are stated to be related to each other and also live in the same locality. It is contended that there were other cross FIRs also between the parties being FIR No.

389/2015 under Section 352/308/34 of IPC and FIR No.

419/2015 under Sections 323/324/325/506/34 of IPC registered at Police Station Fatehpur Beri, New Delhi.

The parties had entered into a compromise deed dated 12.01.2018 wherein it has been agreed that all the FIRs lodged by the respective parties against each other be quashed. Learned counsel for

the parties inform that the said cross FIRs i.e. FIR No. 389/2015 under Section 352/308/34 of IPC and FIR No. 419/2015 under Sections 323/324/325/506/34 of IPC registered at Police Station Fatehpur Beri have already been quashed by a coordinate bench of this Court in Crl. Writ Petition (Crl.) 303/2018 and Writ Petition (Crl.) 304/2018 by an order of today's date.

Respondent no. 2 and 3 are present in person in Court today and identified by the Investigating Officer. They submit that they have settled the disputes. They further submit that they do not wish to press the criminal complaints against the petitioners any further. 5.

In view of the fact that the disputes between the parties have been settled, continuation of criminal proceedings will be an exercise in futility and justice in the case demands that the dispute between the parties is put to an end and peace is restored; securing the ends of justice being the ultimate guiding factor. It would also be expedient to quash the subject FIRs and the consequent proceedings emanating therefrom.

In view of the above, the petition is allowed. FIR No. 340 of 2017 under Sections 323/341/354/354B/308/34 of the IPC Police Station Fatehpur Beri, New Delhi and the consequent proceedings emanating therefrom are, accordingly quashed, subject to the petitioners depositing Rs. 25,000/- with the "Prisoners Welfare Fund, Jail No. 14, Mandoli" Mangal Pandey Marg, Harsh Vihar, Village Mandoli, within two weeks. The receipt of deposit of the costs

imposed by this Order be furnished to the concerned Investigating Officer within a period of three weeks from today 7.
