This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:

"1) Issue a Writ in the nature of mandamus, or any other appropriate Writ/Order/Direction, thereby directing Respondent No.3 to enforce the guidelines issued by the RBI vide notification/circular dated 17.03.2016 bearing number RBI/201516/338 FIDD. MSME & NFSBC. No .21/06.02 .31/2015 -16 "Framework for Revival and Rehabilitation of MSMEs". and/or by placing the Petitioner before the Corrective Action Plan Committee.

2) Issue a Writ in the nature of mandamus, or any other appropriate Writ/Order/Direction, thereby directing Respondent No.3 to restructure/regularize the loan account of the Petitioner as per the guidelines issued by the RBI vide notification/circular dated 17.03.2016 bearing number RBI/2015- 16/338 FIDD. MSME & NFSBC. No .21/06.02 .31/2015 -16 "Framework for Revival and Rehabilitation of MSMEs". and/or..." 2.

For the reasons stated in the petition, issue notice. 3.

Mr. Rout, learned standing counsel accepts notice on behalf of respondent No. 2 and Mr. Sharma, learned counsel accepts notice on behalf of respondent No. 3.

Mr. Dewan, learned senior counsel for the petitioner and Mr. Sharma, learned counsel agree that the petition may be treated as a representation and a speaking order shall be passed after hearing the petitioner.

For the said reasons, it is not necessary to issue notice to respondent Nos. 1 and 4.

It is directed that the petition will be treated as a representation by respondent No. 3 and after giving a personal hearing to the petitioner/ its representative, a detailed speaking order will be passed expeditiously in accordance with applicable extant rules and regulations and not later than 4 weeks from today. 7.
