This is a petition filed under Section 29A(5) of the Arbitration and Conciliation Act, 1996 seeking extension of the mandate of the Arbitral Tribunal by a period of 6 months.

It is stated that in the present case, in view of the application filed by the respondent under Section 17 of Arbitration and Conciliation Act, 1996, there was substantial time consumed in deciding the said application.

Additionally, the tribunal did not hold any hearing as initially no fee was paid any of the parties.

Mr. Dwivedi, learned counsel appearing on behalf of the respondent has not filed a reply, however, he opposes the present petition on the ground that there are violations of principles of natural justice. I am of the view that the same is not within the domain of the Court while deciding an extension of mandate of the Arbitral Tribunal. 6.

Since the parties are before the Arbitral Tribunal for a long period of time and the matter is now listed for arguments, I am of the view that in the interest of justice, the mandate of the Arbitral Tribunal needs to be extended.

In view of the facts noted above, the mandate of the Arbitral Tribunal is extended for a period of 6 months from today. The time after the expiry of the statutory period, if any, stands regularized. 8.

The petition is disposed of in aforesaid terms.
