BAIL APPLN. 878/2024 3.

The present application under Section 439 of the Code of Criminal Procedure, 1973 seeks interim bail on the ground of medical condition of applicant's mother in case FIR No. 531/2018, under Sections 307/323/341/34 of the IPC, registered at P.S. Hari Nagar. 4.

It is stated that the mother is suffering from cerebral vascular accident (CVA) and needs hospitalisation. Documents in support of the application have been verified and status report with regard to the same has been handed over in Court today and taken on record. The concerned doctor has stated that on her last visit she felt that the patient needed hospitalisation. In view of the above, the present application is allowed. The applicant is directed to be released on interim bail for a period of 10 days from the date of release, on his furnishing a personal bond of Rs. 50,000/- with two sureties of like amount, to the satisfaction of the learned Trial Court/Link Court, further subject to following conditions: i.

The applicant shall not leave NCT of Delhi without prior permission of the learned Trial Court.

ii.

The applicant shall intimate the learned Trial Court by way of an affidavit and to the Investigating Officer regarding any change in residential address.

iii.

The applicant shall appear before the learned Trial Court as and when the matter is taken up for hearing.

iv.

The applicant is directed to give his mobile number to the Investigating Officer and keep it operational at all times. v.

The applicant shall not, directly or indirectly, tamper with evidence or try to influence the witness in any manner.

vi.

The applicant shall report at PS: Hari Nagar twice in a week, on Tuesday and Friday at 10:30 AM and the concerned officer is directed to release him by 11:00 AM after recording his presence and completion of all the necessary formalities.

The application is allowed and disposed of accordingly. 7.

Pending application, if any, also stand disposed of. 8.

Copy of the order be sent to the concerned Jail Superintendent for necessary information and compliance.
