% 14.02.2020 CM APPL. 5875/2020 (exemption) Exemption is allowed, subject to all just exceptions. Application stands disposed of.
W.P.(C) 1702/2020 Challenge in this petition is to the judgment dated 18.09.2019 passed by Central Administrative Tribunal ('Tribunal'). Mr. Sanjeev Ralli, learned counsel appearing for the petitioner submits that the communication dated 22.09.2017 issued by Election Commission of India is liable to be quashed which recommends that fresh disciplinary proceedings be initiated against the petitioner on the same charge which has been quashed by the Tribunal in the judgment dated 18.09.2019. After some hearing, learned counsel for the petitioner wishes to withdraw this petition with liberty to seek such remedy as available to him in accordance
with law at the appropriate stage in case a charge-sheet is framed against the petitioner.
Accordingly, the writ petition and CM APPL. 5874/2020 are dismissed as withdrawn. Liberty as prayed for is granted to the petitioner. G.S.SISTANI, J C.HARI SHANKAR, J FEBRUARY 14, 2020 ck / W.P.(C) 1702/2020 2/2
