The learned Counsel for Appellant, after arguing at some length, seeks to withdraw the Appeal as against the order, which is under challenge in the instant Appeal, the Appellant has already preferred a Review Petition before the learned Single Judge.

Accordingly, the Appeal is dismissed as withdrawn. We, however, request the learned Single Judge to expedite the proceedings of the Review Petition and if any application is moved by the Appellant seeking preponement of the date already fixed in the Review Petition, the same shall also be considered and decided expeditiously. The learned Counsel for the Appellant has expressed some apprehension that the Respondents / Workmen may not appear before the learned Single Judge in the proceedings of the Review Petition. 4.

Mr. Biswambar Nayak has stated that he has accepted notice of the Review Petition on behalf of all the Respondents / Workmen and will appear before the learned Single Judge in the proceedings of the Review Petition whenever the same is listed.
