The petitioner is seeking initiation of contempt proceedings against the respondents for violating the statement given before the Court before the learned ARC, South District on 19.04.2012. 4.

None appeared on behalf of the respondent, despite sending advance notice.

Learned counsel for the petitioner has alluded to the order dated 19.04.2012 passed by the learned ASC, South District, whereby the eviction petition under Section 14 (1) (e) of the Delhi Rent Control Act was withdrawn, on the parties reaching an agreement, thereby, inter alia creating a fresh registered lease deed dated 12.03.2012. Learned counsel for the petitioner has alluded to the recital in the lease deed vide Clause (4), which stipulates that a fresh lease was created for a period of 11 years from 01.03.2012 to 28.02.2023, yielding rent of Rs.8,000/- per month. It is urged that the respondent has not vacated the premises after 28.02.2023 and there are also outstanding arrears of rent.

Ex facie, the present contempt petition is not maintainable. The petitioner has appropriate alternate remedies which he may seek for eviction of the respondent and also for recovery of outstanding arrears of rent/damages or user charges.
