% 14.02.2020 CM 5870/2020 Exemption allowed, subject to all just exceptions. WP(C) 1699/2020 The present petition has been filed seeking stay on the execution of the Impugned Order dated 02.01.2020 passed by the learned District Magistrate (South) in Case No.41/2018, titled Gurjeet Singh Grover & Anr v.Rabjyot Grover & Anr.

The petitioners submit that though an appeal was filed under the provision of the Maintenance and Welfare of Parents & Senior Citizens Act, 2007 read with rule 22(2) the Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2009 and Delhi Maintenance and Welfare of Parents and Senior Citizens Rules, 2016 before the Appellate Authority challenging the above Order, however, in the absence of an order of stay, the petitioners

apprehend that they may be evicted from the property in question in execution of the said order. It is further asserted that the appeal is listed before the Appellate Authority on 24.02.2020. Keeping in view that the appeal is listed before the Appellate Authority on 24.02.2020, the operation of the order dated 02.01.2020 referred to hereinabove shall remain stayed till the Appellate Authority considers the interim application of the petitioner filed alongwith the appeal. It is made clear that this Court has not expressed any opinion on the merit of the claim of the petitioners in the present petition. The petition is disposed of in the above terms, with no order as to cost.
