% 26.02.2019 Respondent no.2 is present in Court along with his counsel and has been identified by Insp. Raj Kumar of police station K.M. Pur. He submits that he has settled the matter with petitioners of his own free will and without any undue force, pressure or coercion. He further submits that in view of the settlement he has no objection in case FIR No. 126/2013 under Sections 308/34 IPC registered at police station K.M. Pur and the consequent proceedings are quashed. Affidavit of respondent no.2 to this effect is also on record.
Keeping in mind the settlement arrived at between the petitioners and
respondent no. 2 voluntarily, in my view, no fruitful purpose would be served in keeping the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Miscellaneous applications are disposed of as infructuous.
