The present petition has been filed seeking the following reliefs: "i. Pass an order in the nature of Writ of mandamus thereby the order dated 24.02.2025 passed by Collector of Stamp, Sector-10, Dwarka, Delhi-110075 (Respondent No.1) be held arbitrary and violative of principle of natural justice and hence quashed, in the interest of justice; and ii. Pass an order or further orders that the Hon'ble Court may think fit and appropriate in the interest of justice."

It appears that vide order dated 21.08.2023 this Court appointed a sole arbitrator to adjudicate upon the disputes between the petitioner and respondent no. 3. In the said arbitral proceedings, claimant witness-1, one Mr. Jagdish Sharma, relied upon a „Letter of Extension‟ dated 15.06.2016, which came to be exhibited as Ex. CW-1/5. Thereafter, vide order dated 09.08.2024 passed by the arbitrator, the said letter was impounded and it was held that the same cannot be acted upon till the required stamp duty is The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. paid on the same.

Thereafter, respondent no. 3 filed an application before the respondent no. 2-SDM-cum-Collector of Stamps, Nazafgarh, Delhi, seeking stamping of the said letter. The petitioner, also filed an objection dated 09.12.2024 contesting the said application, where, inter alia, it submitted that the said letter is forged. It was further submitted by the petitioner that stamping on the said document cannot be undertaken unless the original is produced for verification.

In this context, at para. nos. 4 and 5 of the counter affidavit, following averments have been made by respondent no. 2-SDM, Dwarka:- "4. That in compliance of his application a calculation order sheet dated 24.02.2025 was prepared and ask the applicant to submit the original document for completing the process of stamping. However, till date neither applicant appear again before the SDM, Dwarka nor he has submitted that original agreement.
5. That in view of above, it is submitted that till the applicant has not submitted that original agreement till then the process of stamping will not be completed. Hence, it may be treated as Null and void." 5.
It is thus seen that according to the said respondent as well, the document in question has been treated to be null and void. The respondent has also, explicitly, taken the stand, that till the original document is not produced, stamping cannot be undertaken. Accordingly, the document is directed to be treated as being null and void as stated by respondent no. 2 in their counter affidavit.

No further adjudication is required in the instant matter. The instant petition is, therefore, disposed of along with all pending applications.
