O R D E R
% 28.03.2025 CRL.M.A. 9563/2025 (for modification of order dated 10th March, 2025) 1.
Through this application, the Petitioner seeks modification of the bail conditions in the order dated 10th March, 2025. It is firstly pointed out that the Petitioner does not have any person who is willing to stand as a surety and seeks modification of this condition. In this regard, it has also been pointed out that on an earlier occasion, when the Petitioner was granted furlough in the year 2023, he was released only on furnishing of a cash surety of Rs.4000/- along with a personal bond in the like amount. 2.
Additionally, it is pointed out that the Petitioner is a resident of West Bengal, and therefore, the condition imposed by this Court directing that he shall not leave the NCT of Delhi during the period of furlough, would The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. deprive the Petitioner from establishing his social-ties. 3.
Considering the above, the following conditions in Paragraph No. 12 of the order dated 10th March, 2025 shall now be read as under: "12.
Accordingly, the impugned order bearing No.
F.10 (003526585)/CJ/Legal/PHQ/2025/M-1650 dated 19th February, 2025, rejecting the Petitioner's furlough application is hereby quashed. The Respondent is directed to release the Petitioner on first spell of furlough for a period of 21 days, to re-establish the social-ties with family members, on furnishing of a cash surety of Rs.10,000/- and a personal bond in the sum of INR 10,000/- subject to the satisfaction of the Jail Superintendent/Trial Court/Duty Metropolitan Magistrate, and further subject to the following conditions:
(i) The Petitioner shall provide the mobile number(s) to the concerned Jail Superintendent and SHO - P.S. Shakarpur, Delhi, at the time of his release, which mobile number shall be kept in a working condition at all times.
(ii) The Petitioner shall appear before the SHO, P.S. Karimpur, Nadia District, West Bengal, on every Monday between 11:00 AM and 11:30 AM to mark his presence. However, he shall not be kept waiting for longer than one hour for this purpose. A confirmation to this effect shall be conveyed by SHO, P.S. Karimpur, Nadia District, West Bengal to the concerned Police Station at Delhi. (iii) The Petitioner shall positively surrender before the concerned Jail Superintendent on the expiry of the period of furlough." 4.
Copy of the order be sent to the Jail Superintendent for information and necessary compliance.
