This petition has been filed seeking quashing of FIR No.730/2023 PS Dayalpur under Sections 308/34 IPC on the basis of a settlement arrived at between the parties dated 26th February, 2024 which is on record of this Court. It is stated that the petitioner and the complainants are neighbours and the issue arose out of some altercation between them. As per the settlement, they have sorted out their disputes. 2.

An amount of Rs.2 Lacs was agreed to be paid by the petitioner to the complainants, out of which an outstanding amount of Rs.15,000/- has been paid to respondent No.2 in Court. The petitioner and respondent Nos.2 and 3/complainants are present in Court and duly identified by the IO. 3.

Respondent Nos.2 and 3 state that they have no objection to the quashing of the said FIR.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No.730/2023 PS Dayalpur under Sections 308/34 IPC and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 6.

Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
