% 27.02.2019 By this petition, the petitioner seeks parole on the ground that she wishes to meet her children as she apprehends about them to be in danger and wants to secure them.
Notice.
Learned proxy counsel for learned ASC for the State accepts notice. Status report has been handed over which is taken on record. As per the status report verification was done from the house of the petitioner where her two children, namely, Rizwan and Anamta were found residing with the sister of the petitioner. The sister of the petitioner was residing in a separate room and have been staying there for the last 14-15 years. The children stated that their mother is presently in jail for the last four years W.P.(CRL) 621/2019
and they are living with Bakila, the sister of the petitioner, who mostly cooks food for them except when they want to do on their own. The parole application of the petitioner was rejected on the ground that six months had not elapsed from the last surrender which was on 24th August, 2018. Since the petitioner wants to meet her children and personally see whether the children are safe and wants to make some financial arrangement for them, this Court deems it fit to grant parole particulary because of the fact that now six months have already elapsed from the date of surrender. Consequently, the petitioner is directed to be released on parole for a period of four weeks on her furnishing a personal bond in the sum of ₹25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court.
Petition is disposed of.
Copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
