The present petition under Section 439 (2) read with Section 482 of the Cr.P.C. seeks the following prayers:- "a) Pass an order thereby canceling the bail of the Respondent No. 2 granted vide order 20.04.2022 by this Hon'ble court in case FIR No. 182/2021 registered under Section 376/506 IPC registered at P.S Nabi Karim, Delhi b) Pass any other order this Hon'ble Court may deem fit in the facts and circumstances of the case and in the interest of justice."

Vide order dated 02.09.2024, the learned Predecessor Bench of this Court had passed the following order:- "1. Present none for the petitioner.

petitioner conveyed her inability to appear in Court today to the I.O. He further submits that the order passed today shall be brought to the notice of the petitioner and her counsel.

4. At this stage, learned counsel for respondent No.2 submits that the petitioner has been partly examined and has not appeared before the Trial Court for the last three dates.
5. Later, Mr. Kshitiz Ahuja, counsel for the petitioner appeared and he has been apprised of the order."

Thereafter there has been no appearance on behalf of the petitioner on 09.10.2024 and 18.11.2024. There is no appearance on behalf of the petitioner today as well despite pass over.

In view of the above, the present petition is dismissed in default for non-prosecution and disposed of accordingly.
