% 27.02.2019 Allegations against the petitioner are that she trespassed the property bearing no. 4466, 7/13, Ansari Road, Darya Ganj, New Delhi-02 after forging the documents of sale in her favour and stolen the goods. Learned counsel for the petitioner submits that petitioner had purchased the aforesaid property from one Rajneesh for `36 lacs out of which `5 lacs was paid in cash to Rajneesh, whereafter petitioner was put in possession of the property by Rajneesh. It is submitted that petitioner is a student and may be granted anticipatory bail. Learned APP has opposed the grant of anticipatory bail to petitioner. It is contended that Manish Jain is the owner of the subject property. Rajneesh had filed a suit for injection against Manish Jain in respect of the

aforesaid property, which is still pending. In the said suit, even injunction was not granted to Rajneesh.

Petitioner in collusion with Rajneesh got prepared the forged documents, that is, GPA, Agreement to Sell, Will etc. in respect of the property in question. The documents have yet to be verified. Keeping in mind the serious allegations levelled against the petitioner, in my view, no case is made out for granting anticipatory bail to petitioner. Bail application is dismissed. Miscellaneous application is disposed of as infructuous.
